TERMS AND CONDITIONS FOR THE USE OF THE WEBSITES AND THE SALE OF GOODS

These Terms and Conditions constitute an agreement between S & K Company Ltd. and every user accessing the websites, online stores, and electronic services owned or operated by the Company. By using the relevant website and/or placing an order, the user acknowledges that they have read, understood, and agreed to these Terms and Conditions.

3. Definitions

For the purposes of these Terms and Conditions:

Merchant means S & K Company Ltd.

Website means any website owned or operated by the Company.

User means any person who accesses or uses the Website.

Customer means any person who places an order.

Order means an electronic declaration for the purchase of goods.

Business Day means any day from Monday to Friday, excluding official public holidays in the Republic of Bulgaria.


4. Acceptance of the Terms and Conditions

By using the Website, the User declares that they have read, understood, and accepted these Terms and Conditions.

By placing an order, the Customer confirms acceptance of these Terms and Conditions.


II. REGISTRATION

5. Registration

Orders may be placed:

  • by creating a customer account;
  • as a guest, where such option is available on the Website.

When registering, the Customer is required to provide accurate, complete, and up-to-date information.

If any of the provided information changes, the Customer shall promptly update their account details.


6. Customer Account

Each registered Customer is responsible for:

  • keeping their username and password confidential;
  • all activities performed through their account;
  • immediately notifying the Company in the event of suspected unauthorized access to their account.

III. PRODUCTS

7. Product Information

The Company makes every reasonable effort to ensure that the information published about its products is accurate and up to date.

Minor differences may occur with respect to:

  • product images;
  • colours;
  • packaging;
  • design;
  • technical specifications where changes have been introduced by the manufacturer.

All product images are for illustrative purposes only.


8. Product Availability

All orders are subject to product availability.

If a product is unavailable, the Customer will be informed without undue delay.

The Company may offer:

  • a substitute product;
  • partial delivery;
  • a full refund of the amount paid.

9. Prices

All prices are displayed in the currency selected on the Website.

Where applicable, prices include Value Added Tax (VAT).

Delivery charges are displayed separately before the order is completed.


10. Price Changes

S & K Company Ltd. reserves the right to change product prices at any time.

The price applicable to the Customer shall be the price displayed on the Website at the time the order is confirmed.


11. Promotions

Promotional campaigns shall be valid:

  • while stocks last;
  • until the specified end date;
  • subject to the terms and conditions of the respective promotional campaign.

Promotions cannot be combined unless expressly stated otherwise.


IV. ORDERS

12. Placing an Order

Orders may be placed through the websites of S & K Company Ltd. 24 hours a day, 7 days a week.

To place an order, the Customer shall:

  • select the desired products;
  • add the products to the shopping cart;
  • provide the required billing and delivery information;
  • select a payment method and delivery method;
  • confirm acceptance of these Terms and Conditions and the Privacy Policy;
  • complete the order.

Submitting an order constitutes an offer by the Customer to enter into a contract for the purchase of goods.


13. Order Confirmation

Upon receipt of the order, the Customer will automatically receive an electronic confirmation acknowledging that the order has been successfully registered.

The automatic confirmation does not constitute acceptance of the order by the Company.

The sales contract shall be deemed concluded only after the order has been expressly confirmed by S & K Company Ltd. or upon dispatch of the ordered goods.


14. Refusal to Fulfil an Order

S & K Company Ltd. reserves the right to refuse to process or fulfil an order for legitimate reasons, including but not limited to:

  • product unavailability;
  • obvious technical errors relating to prices or product descriptions;
  • incorrect or incomplete customer information;
  • suspected fraud or abuse;
  • inability to contact the Customer;
  • previous failure by the Customer to fulfil contractual obligations.

Where payment has already been made, the amount paid shall be refunded using the same payment method originally used, unless otherwise agreed between the parties.


V. PAYMENT METHODS

15. Payment Methods

Depending on the particular website and the destination country, the following payment methods may be available:

  • bank transfer;
  • payment by debit or credit card;
  • cash on delivery (where available);
  • other electronic payment methods.

The available payment methods will be displayed before the order is completed.


16. Payment Security

Payments made by bank card are processed by licensed payment service providers.

S & K Company Ltd. does not store the full payment card details of its Customers.


VI. DELIVERY

17. Delivery

Deliveries are carried out through selected courier companies or other logistics partners.

The goods shall be delivered to the address specified by the Customer or to the selected courier office.

Delivery times are indicative and may vary depending on:

  • product availability;
  • destination;
  • courier workload;
  • official public holidays;
  • force majeure events.

18. International Deliveries

For international deliveries, the Customer shall be responsible for any applicable customs duties, local taxes, import charges, or other governmental fees, unless expressly stated otherwise.


19. Inspection upon Delivery

Upon receiving the shipment, the Customer should immediately inspect:

  • the integrity of the packaging;
  • the quantity of the delivered products;
  • any visible damage;
  • compliance of the delivered goods with the order placed.

If transport damage is identified, the Customer is advised to request that the courier prepares a damage report at the time of delivery.

VII. RIGHT OF WITHDRAWAL

20. Right of Withdrawal

Where the Customer qualifies as a consumer within the meaning of the applicable consumer protection legislation, they shall have the right to withdraw from a distance contract within 14 days from the date of receipt of the goods, without giving any reason.

To exercise this right, the Customer must notify S & K Company Ltd. by means of an unequivocal written statement sent by e-mail or to the Company's registered address.


21. Refunds

Upon receipt of the returned goods and verification of their condition, S & K Company Ltd. shall reimburse the Customer for all payments received, excluding any additional delivery costs resulting from the Customer's choice of a delivery method other than the least expensive standard delivery option offered by the Company.

The refund shall be made without undue delay and no later than 14 days from the date the Company receives the withdrawal notice. The Company may withhold the reimbursement until it has received the returned goods or proof that the goods have been sent back, whichever occurs first.


22. Exceptions to the Right of Withdrawal

The right of withdrawal shall not apply in the cases provided for under the applicable consumer protection legislation, including, but not limited to:

  • goods manufactured according to the Customer's individual specifications or clearly personalised;
  • sealed goods which are not suitable for return due to health protection or hygiene reasons, where the seal has been broken after delivery;
  • any other cases provided for under the applicable legislation.

VIII. COMPLAINTS AND WARRANTIES

23. Complaints

If the delivered goods do not conform to the sales contract, the Customer shall have the right to submit a complaint in accordance with the applicable legislation.

Complaints may be submitted:

  • by e-mail;
  • in writing to the Company's registered address;
  • through the contact form available on the relevant website, where applicable.

When submitting a complaint, the Customer should provide:

  • the order or invoice number;
  • a description of the issue;
  • photographs, where applicable;
  • the preferred method of resolving the complaint.

24. Warranty

Products are covered by the warranty terms provided by the manufacturer or importer, where applicable.

Where a statutory warranty applies, it shall be provided in accordance with the applicable legislation.

For professional equipment, different warranty conditions may apply, as specified in the warranty certificate or in an individual agreement.


25. Warranty Exclusions

The warranty does not cover damage resulting from:

  • improper use;
  • failure to follow the operating instructions;
  • mechanical damage;
  • improper storage;
  • unauthorized repairs or modifications;
  • normal wear and tear;
  • force majeure events.

Any disputes shall first be settled through negotiations and mutual agreement between the parties.

If no amicable settlement can be reached, the dispute shall be submitted to the competent Bulgarian court.


XIV. ALTERNATIVE DISPUTE RESOLUTION

33. Online Dispute Resolution (ODR)

Consumers may use the European Online Dispute Resolution (ODR) Platform available at:

The use of the ODR Platform shall not affect the parties' right to seek legal protection before the competent courts.


XV. AMENDMENTS TO THE TERMS AND CONDITIONS

34. Updates

S & K Company Ltd. reserves the right to amend these Terms and Conditions in the event of changes in legislation, the services offered, or the Company's business operations.

The amended version shall enter into force on the date of its publication on the relevant Website.

  • cannot be combined unless expressly stated otherwise;
  • may be terminated at any time due to technical errors or force majeure events.

In the event of an obvious pricing error caused by a technical malfunction, the Company reserves the right to cancel the order, immediately notify the Customer, and refund all payments received.


43. Limitation of Liability for Website Content

S & K Company Ltd. makes reasonable efforts to ensure that the information published on the Website is accurate and up to date.

However, the Company does not guarantee that the published content is complete, free from technical errors, or continuously updated.

The Company reserves the right to modify the content of the Website at any time without prior notice.


44. Applicable Legislation

These Terms and Conditions shall be governed by the laws of the Republic of Bulgaria and the applicable legislation of the European Union.

Any disputes that cannot be resolved through mutual agreement shall be submitted to the competent courts of the Republic of Bulgaria.
